Subscription Terms.

By subscribing to any Design Foundry plan, you agree to the following:

The Design Foundry Group Service Agreement

Business Name: The Design Foundry Group

This Service Agreement ("Agreement") is made effective as of the date of subscribing to the chosen Design Foundry Subscription (sending a remit for the chosen Design Foundry Subscription) and between The Design Foundry Group ("Service Provider") and the subscriber ("Client").

1. Services

The Service Provider agrees to provide the following services under the selected subscription plan:

  • Core Plan: Includes 2 design requests and 2 revisions per request. Additional requests are $250 each (maximum 2 additional requests). Additional revisions are $100 each. Excludes Web Design and Brand Identity Services. $597 per month including GST.
  • Growth Plan: Includes 7 design requests and unlimited revisions. Additional requests are $200 each with no cap on additional requests. Excludes Web Design and Brand Identity Services. $1997 per month including GST.
  • Unlimited Plan: Includes unlimited requests and unlimited revisions. Includes Web Design and Brand Identity Services. $3497 per month including GST.
2. Term and Renewal
  • Each subscription plan lasts for 30 days and does not renew automatically.
  • An invoice for the next 30 days will be sent 7 days prior to the subscription expiration. The new subscription term begins upon receipt of payment.
  • The Client may change their subscription plan after the end of each 30-day period.
3. Payment Terms
  • Payment for the subscription is due in advance for the 30-day period.
  • There are no refunds or pro-rata refunds available.
4. Turnaround Time
  • The turnaround time for each request is estimated between 24-48 hours. This timeframe is not guaranteed and may vary based on the nature of the work.
5. Intellectual Property
  • Upon delivery and acceptance, each piece of work becomes the intellectual property of the Client.
  • Denied work remains the intellectual property of the Service Provider.
  • The Service Provider retains the right to showcase client-approved work on any medium unless the Client requests otherwise by contacting accounts@thedesignfoundry.com.au.
6. Cancellation
  • The Client may cancel their subscription by contacting accounts@thedesignfoundry.com.au.
  • No refunds will be provided for cancellations made part-way through the subscription. The cancellation will be effective at the end of the current billing period.
7. Outsourcing
  • The Service Provider may outsource work to contractors within Australia. Any outsourcing outside Australia will be communicated to the Client.
  • The Client will have a dedicated designer that will work with them for the duration of their billing period. If this is not the case, this will be communicated to the Client. The dedicated designer may need to work with an additional person to complete work requested of them. This does not need to be communicated to the Client but may be done so under our discretion.
8. Liability
  • The Service Provider is released from any liability, including but not limited to, claims arising from negligence, breach of contract, or any other legal theory.
9. Amendments
  • The Service Provider reserves the right to modify the terms, plan inclusions, pricing, and offerings of this Agreement at any time.
10. Services Offered

The following services are typically requested and included under the subscription plans, subject to the plan's limitations:

  • Email Design
  • Posters and Billboards
  • Letterheads
  • Business Cards
  • Brochures
  • Packaging Design
  • Social Media Graphics
  • Motion Graphics
  • Business-specific Marketing Material (e.g., product guides, food shopping lists)
  • Logos
  • Brand Identity Systems
  • Brand Collateral
  • Landing Page Design (Figma)
  • Website Design (Figma)
  • Expo Designs
11. Governing Law
  • This Agreement shall be governed by and construed in accordance with the laws of Queensland, Australia.
12. Dispute Resolution
  • Any disputes arising out of or in connection with this Agreement shall be resolved in Queensland, Australia.
13. Confidentiality
  • Both parties agree to keep confidential all information that is not publicly available and disclosed by the other party during the term of this Agreement and thereafter.
14. Force Majeure
  • Neither party shall be liable for any failure to perform its obligations under this Agreement if such failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, riots, strikes, or other labor disputes, natural disasters, or governmental orders.
15. Entire Agreement
  • This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written, between the parties.
16. Severability
  • If any provision of this Agreement is found to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect.
17. Notices
  • Any notices required or permitted to be given under this Agreement shall be in writing and shall be deemed to have been duly given if delivered by email, or mailed by certified or registered mail, return receipt requested, to the addresses provided by the parties.
18. Acceptance of Terms
  • By starting the subscription (sending a remit for the chosen Design Foundry Subscription), the Client agrees to the terms and conditions set forth in this Agreement.

How does the subscription work?

Simply choose a plan and get started! You'll have access to your own Asana Board, where you can submit design requests. Provide as much information as you like, and we'll get to work promptly.

Our subscription does not renew automatically. We'll send an invoice 7 days prior to the subscription.

What industries do you cater to?

We love working with every industry possible as we love to learn about your business! If you have doubts, ask us for a work example from your industry.

Why should I use Design Foundry when I can just hire someone?

Hiring someone can be costly, considering expenses like taxes, superannuation, holidays, and office equipment, not to mention the risk of not having enough work to justify their salary. With Design Foundry, you enjoy flexibility—you can pause or cancel your subscription at any time. This way, you keep costs low while maintaining high-quality results.

Does the subscription auto-renew?

The Design Foundry Subscription plans do not renew automatically. We'll send an invoice for the next 30 days, 7 days prior to your existing subscription expiring. We accept bank transfer, credit card or direct debit as a payment method.

Are my design requests passed on to multiple people?

With Design Foundry, you'll be paired with your own dedicated designer who will handle all your design requests. If a task requires additional expertise, your designer will collaborate with another team member and keep you informed throughout the process.

How does the request system work?

When you make a request, your dedicated designer will begin work on it and should have a proof ready for you within 24-48 hours. Your designer may take on multiple requests at a time depending on their priority and time availability.

How do I structure my due dates for tasks?

We recommend setting the due date 48 hours in advance, so that our designers have ample time to meet your brief and deliver a quality result. Feel free to add multiple tasks at once.

Are there any hidden fees?

This is also a simple one. No. We charge a flat monthly fee for everything you see here.

How secure is my information?

100% Secure. Asana is hosted on SOC 2 audited data centers, meaning that all servers are firewalled to permit the minimum traffic necessary to run the service, and access to those servers is limited to Asana employees with a legitimate business need. Stripe is also certified as a Level 1 Service Provider, which is the highest level of certification for payment processors.
